Premises Liability Cases
Every year, people in Alabama get injured on someone else’s property. Property owners and businesses must keep their property safe for visitors. If they know about hidden dangers, they must warn others. This is called premises liability.
Legal Status of the Injured Person
In Alabama, the injured person can be an Invitee, a Licensee, or a Trespasser:
- Invitee: Someone invited onto the property for business purposes. The owner must keep the property safe.
- Licensee: Someone allowed on the property for their own reasons. The owner owes a lower duty of care.
- Trespasser: Someone on the property without permission. The owner owes the least duty of care but can’t set traps to harm them.
Types of Premises Liability Cases
Common cases include:
- Slip-and-falls from slippery floors or debris
- Trip-and-falls from damaged stairs or poor maintenance
- Poor lighting
- Products falling off shelves
- Pool drownings
Criminal Assaults on Business Premises
Business owners are usually not responsible for criminal acts by third parties, but there are exceptions. It’s important to consult a lawyer experienced in premises liability cases.
